Establish who owns what before discussing a solution
Where several heirs share an estate, their interests are undivided shares. A half share in a house does not automatically mean that one heir owns the upper floor and the other the lower floor. Distinguish any practical arrangement for using the building from the ownership rights recorded in the property documents.
Before discussing a sale or buyout, collect the deeds, succession documents, any will and the available Land Registry records. Record who uses the property, whether rent is received and which expenses have been paid. If the identity of an heir or the size of a share is disputed, that issue needs separate investigation. Do not base a valuation or offer solely on a relative's informal description of the estate.
A negotiated solution must be workable
An organised discussion can explore a co-heir buying another's share, a joint sale to a third party or division into separate properties where legally possible. An interim arrangement for occupation or letting may help while a final solution is prepared, but is not the same as partitioning ownership. Mediation can also support negotiations without presuming that an agreement will be reached.
Each proposal needs a realistic valuation, technical checks where relevant and an allocation of expenses. Someone who wants to keep the whole house should explain how a buyout would be financed. An agreement affecting rights in Greek real estate must meet the required legal form and registration requirements; a handwritten family note should not be treated as a completed transfer. For heirs abroad, representation and document preparation should be planned before fixing a completion date.
- Each co-heir's preferred solution and underlying concerns
- Valuation and practical funding for any proposed buyout
- Technical or registration obstacles needing resolution
- A timetable, expenses and interim property management
If agreement fails: what court partition can involve
Partition in kind depends on the property's characteristics and whether a lawful, practical division is possible. General partition rules also provide for sale by auction when division in kind is impossible or economically disadvantageous. The answer does not depend simply on which heir currently lives in the property.
Under the new Civil Code Article 1883, the court may, on request and subject to the statutory conditions, award another co-heir's share against payment of its market value where partition in kind is impossible or disadvantageous. This is not an automatic right to buy at a self-selected price. The applicable regime, pleaded requests and evidence must be assessed.
Why the 2026 transitional rule matters even for an older estate
Law 5303/2026 contains a specific partition transition: after 16 September 2026, its partition rules also cover earlier deaths if no partition action has been brought. Saying that an estate is old therefore does not settle the applicable rules. The file and any pending proceedings must be checked before selecting the legal basis and relief sought.
For an initial appointment with a lawyer in Heraklion, provide any pleadings already filed or served and a short explanation of your preferred outcome. Separate the ownership issue from possible claims concerning rent, expenses or exclusive use. If relatives live in different countries, identify where documents are held and who can communicate on each person's behalf. The aim is an achievable strategy with a realistic assessment of cost and risk, not a promise of a particular judgment.
