Distinguish jurisdiction from the law governing the divorce
If one spouse lives in Crete and the other abroad, begin with a clear residence and nationality history. The place of marriage alone does not determine where proceedings can be started. Where EU rules apply, habitual residence and other prescribed connecting factors matter.
Jurisdiction is separate from the law governing the dissolution of the marriage. Rome III addresses the latter, while Regulation 2019/1111 covers different matters, including jurisdiction and recognition. EU arrangements do not apply identically to every country or time period; a non-participating country or a country outside the EU requires particular assessment.
Agreement does not mean that an email is enough
Where the spouses agree, assess whether a Greek consensual procedure is available and how it can be completed. The gov.gr digital service is initiated by a lawyer and involves both spouses, their respective lawyers and a notary. The required identification details and correct registration of the marriage are important service conditions.
Living abroad does not automatically mean everything can be completed remotely without further preparation. Approval and signing arrangements, any special power of attorney and acts requiring a notary need checking. Do not share personal Taxisnet credentials. If there is no agreement, service of documents abroad and related deadlines need to be planned promptly by the lawyer.
What to organise before the first appointment
A short schedule of countries, moving dates and available documents helps the initial assessment. Explain whether proceedings have already started elsewhere or any document has been served. Do not order translations or authentication indiscriminately before the destination and intended use of each document are established.
The first enquiry can be a concise outline with any urgent date. Arrange how to send detailed family papers, particularly children’s documents, afterwards. The following checklist supports preparation; it is not a complete statement of the documents legally required for every case.
- Marriage details, the marriage record and available identification
- Both spouses’ nationalities and residence timeline
- The available precise address of the spouse abroad
- Earlier agreements, proceedings, decisions and proof of service
- A short account of questions involving children, maintenance or property

Children, assets and using the divorce in another country
Dissolving the marriage does not automatically settle parental responsibility, maintenance and property claims. These do not all fall within Rome III. Each needs separate assessment, especially where a child or significant assets are elsewhere. Do not relocate a child or enter property commitments on the assumption that agreement to divorce is sufficient.
Establish early where the instrument or judgment will be used. European recognition arrangements do not eliminate every certificate, translation or civil-register update; countries outside the EU require their own assessment. The appropriate route for someone based in Heraklion depends on the actual connections and documents. Sources checked on 23 October 2026.
