Motorcycle accidents in Greece: helmets, contributory negligence and compensation

Motorcycle accidents in Heraklion: evidence, helmet use, contributory negligence, personal injury claims and reviewing an insurer's settlement offer.

After attending to the injured person, organise the facts

Immediate assistance and medical care take priority over compensation discussions after a motorcycle collision. Where safe and possible, preserve information about the location, signs, vehicle positions, marks and witnesses. Do not put anyone at risk to obtain a better photograph or move an injured person for documentation purposes.

Separate the sequence of the collision from the subsequent development of the injuries. Record direction of travel, priority and available witness accounts without turning assumptions into established facts. Keep the initial medical assessment, follow-up records and treatment instructions. Request the appropriate police material through the relevant procedure: a single document may not contain the complete evidential record. For visitors to Crete, organising these records before departure can make later communication and assessment more straightforward.

Helmet use: the connection to the particular injury matters

The current Traffic Code requires riders and passengers on mopeds and motorcycles without an enclosed cabin to wear a properly fastened protective helmet. Breaching that duty and assessing civil compensation are distinct issues.

The compensation assessment considers whether and how the omission contributed to the particular injury. Piraeus Court of Appeal judgment 763/2018 illustrates the importance of causation between helmet non-use and injury. It does not establish one percentage for every accident. We should not infer that the missing helmet caused the collision, removed every claim or affects all injuries in exactly the same way. The actual mechanism of injury and the medical evidence need examination rather than an automatic deduction based on a general statement.

Different losses require different supporting records

Depending on the facts, claims may concern medical expenses, necessary care, lost income, disability-related consequences and non-pecuniary harm. The case law distinguishes these heads of claim: they are not an automatic combined award and each requires its own conditions to be met. Damage to the motorcycle and equipment should also be organised separately.

Retain receipts, medical opinions and employment records showing what changed after the accident. Photograph and preserve damaged equipment for possible assessment without continuing to use a damaged helmet. Before repairing or disposing of the motorcycle, arrange the necessary damage documentation. A repair quotation is useful but does not describe the impact on health or employment. Keep the insurer's correspondence together with the evidence so that any proposed settlement can be compared with the losses actually documented.

  • Evidence of absence from work and income records
  • Photographs, damage assessment and vehicle/equipment documents
  • Insurance correspondence and every written settlement offer

Licence questions, settlement offers and the next step

If driving entitlement is disputed, examine the actual categories and equivalences rather than merely asking whether a car licence exists. It is unsafe to determine responsibility for the accident solely from one traffic ticket or an insurer's verbal position. Administrative, criminal and insurance issues require coordinated but distinct assessment. A foreign licence or a rented scooter adds documents to check, not a shortcut to a conclusion about the claim.

Before signing a full and final settlement, identify the claims it covers and whether the medical picture is sufficiently documented. For an accident in Heraklion or elsewhere in Crete, an initial legal consultation helps organise evidence, deadlines and any necessary technical or medical assessment. The objective is a properly supported claim, not a promised compensation figure or outcome before the evidence has been examined.
